Terms of Service

NextGen AI Pty Ltd (“NextGen AI”, “we”, “us” or “our”) is an Australian company. By accessing or using our website, applications, and courses (together, the “Services”), you agree to be bound by the terms below. If you do not agree, please do not use the Services.

1. Acceptance of these terms

By creating an account, purchasing a course, or clicking to accept these terms, you confirm that you are at least 16 years of age and have the legal capacity to enter into this agreement. If you are using the Services on behalf of an organisation, you represent that you are authorised to bind that organisation, and “you” refers to both you and that organisation. These terms operate together with our Privacy Policy, which forms part of this agreement.

2. Your account

To access most of our courses you will need to register for an account. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Accounts are for a single named individual and may not be shared, resold, or used by more than one person. Please notify us promptly at support@nextgenai.com if you suspect any unauthorised use of your account.

3. Course access & licence

When you purchase a course, we grant you a personal, non-transferable, non-exclusive, revocable licence to access and view that course’s materials for your own learning. Unless a course is expressly offered on a subscription or time-limited basis, your purchased courses come with lifetime access — you may return to them for as long as we continue to operate the platform and offer that course. This licence does not permit you to download, copy, distribute, publicly display, sell, sublicense, or create derivative works from the course materials except where a feature (such as downloadable project files) is expressly provided for that purpose.

4. Payments & pricing

All prices are listed in Australian Dollars (AUD) and, unless stated otherwise, are inclusive of GST where applicable. Payment is processed securely through our third-party payment providers, and by submitting payment details you authorise us to charge the applicable fees. We may change our prices from time to time, but any change will not affect courses you have already purchased. Where a course is offered on a recurring subscription, it will renew automatically at the then-current price until you cancel, which you can do at any time from your dashboard.

5. Refunds

We stand behind our courses with a 30-day money-back guarantee. If you are not satisfied, you may request a full refund within 30 days of your purchase, subject to the conditions set out in our Refund Policy. Nothing in these terms limits your rights under the Australian Consumer Law, including any guarantees that cannot lawfully be excluded.

6. Intellectual property

All content on the platform — including course videos, written lessons, project templates, code samples, graphics, logos, and the NextGen AI name and branding — is owned by or licensed to NextGen AI and is protected by copyright, trademark, and other intellectual property laws. Except for the limited licence granted in section 3, no rights are transferred to you. Any projects or work products you create using our lessons remain yours; you are free to use them, including in your own portfolio and commercial work.

7. Acceptable use

You agree to use the Services lawfully and respectfully. You must not share your account or course access with others; scrape, record, or redistribute course materials; attempt to bypass any access controls or digital rights protections; upload malicious code; harass other learners or our staff; or use the Services to build a competing product. We may suspend or terminate accounts that breach these rules, and in cases of serious misuse we may do so without a refund.

8. Disclaimers

Our courses are provided for educational purposes. While we work hard to keep our content accurate and current in a fast-moving field, we do not warrant that the Services will be uninterrupted, error-free, or that any particular outcome — such as employment, income, or business results — will follow from completing a course. To the maximum extent permitted by law, and except for guarantees that cannot be excluded under the Australian Consumer Law, the Services are provided “as is” and “as available” without warranties of any kind.

9. Limitation of liability

To the extent permitted by law, NextGen AI will not be liable for any indirect, incidental, special, or consequential loss, or for loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services. Where our liability cannot be excluded but can be limited, our total liability to you is limited, at our option, to resupplying the relevant course or refunding the amount you paid for it. Nothing in this section limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded or limited.

10. Governing law

These terms are governed by the laws of Victoria, Australia. You and NextGen AI submit to the non-exclusive jurisdiction of the courts of that state and the Commonwealth of Australia. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

11. Changes to these terms

We may update these terms from time to time to reflect changes to our Services, the law, or our business. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you by email or through the platform. Your continued use of the Services after changes take effect means you accept the revised terms.
